SSI and SSDIIt is not uncommon for a disability claim to initially be denied. Research shows that over 75% of those who initially apply for Social Security benefits are denied. However, research also shows that more than 75% of persons who appeal their cases and have legal representation are approved for benefits. Do I need a Social Security Attorney? Social Security is a Federal program that most people believe only provides retirement benefits. That is not the case. Social Security Disability Insurance (SSDI) is part of the Federal Social Security program that allows monthly payments to those who are younger than the full retirement age, incapable of performing substantial employment activities and have sufficient quarters of work credit to qualify for disability benefits. On the other hand, Supplement Security Income (SSI) is part of the Social Security Program that pays monthly disability benefits to those who have not worked long enough to qualify for SSDI.
To qualify for SSI or SSDI, a claimant must be able to show the Social Security Administration that they are disabled under the Social Security Administration’s rules. Social Security finds a claimant disabled when the claimant proves that they are incapable of performing substantial gainful employment. Social Security Disability ApplicationIt takes approximately four to six months for your initial Social Security Disability Application to be processed. Some of that delay is due to the amount of time it takes to receive your medical records from the various providers. During this application period, it is important that you keep the Social Security Administration informed of any changes in your address or phone number. You should always make sure that they have the most up to date information on you. For help on the Social Security Application process. Vocational Experts and Medical Experts are there to help explain the medical records or your skill level at work to the ALJ. This should not be viewed negatively.
